Stop The Legislative Power Grab-Hands Off The Courts

What's Going On?

There’s a cohort of bills targeting the judicial system that have recently been released, and they threaten our constitutional rights and the balance of power in our government.

Why Is It Bad?

Each bill is designed to protect and expand the Utah Legislature’s power and violates the separation of powers between the legislative and judicial branches of our government. These bills make it easier for the legislature to pass unconstitutional laws without consequence.

More than that, they’re vindictive. It’s no secret legislative leadership is upset at certain Utah Supreme Court decisions in recent months. Disagreement with branches of government and checks on power are part of a healthy democracy.

This is a misuse of legislative power being wielded to interfere with the courts who were just doing their jobs. Legislative power should be wielded for public good, not used to meddle with an equal branch of government.

Talking Points

I’m writing as one of your constituents to express my concern with bills that have been proposed this legislative session that attack the judicial process and our courts in Utah. When they come up on the floor, please oppose SJR 9 and SB 296.

SJR 9 erodes the ability of the judicial process to check legislative power by creating an unnecessary and aggressive timeline for laws to be challenged. It restricts our right to challenge unconstitutional laws.

SB 296 would bring partisan politics into the judiciary. The judiciary is a coequal branch of government, and our state constitution implemented a separation of powers between the legislative and judicial branches to encourage healthy checks and balances.
